Probation Revocations

ARE YOU AT RISK OF HAVING YOUR PROBATION REVOKED IN WYOMING?

From the day you start probation until about a month after your completion date, you could have your probation revoked (canceled) for any violation of the terms and conditions set forth in that probation. These violations include, among other things, any new arrests or charges, positive drug or alcohol screening tests, failure to complete any court mandated testing or counseling, or failure to pay fines. 


If you are suspected of violating any of the terms of your probation, a petition for revocation could be initiated and you could be arrested and brought before the court to answer to the allegations. You have a right to a hearing and you have the right to be represented by an attorney.


A probation revocation can mean that you will have to serve part or all of your originally suspended term of incarceration. A probation revocation could mean that you have lost your deferral.

WHAT DOES BEING ON PROBATION IN WYOMING MEAN?

If you are convicted of a crime, you could face penalties which include a fine, a term of incarceration, or both. In some cases, you could have both the fine or the jail term, or both, suspended, and, in exchange, be placed on probation – with certain terms and conditions - for a specific period of time. 


While on probation, you are still under the supervision of the criminal justice system.


Probation is either supervised or unsupervised. If you are placed on Supervised Probation, you will have a probation officer to whom you will report. There may also be random visits to make sure you are in full compliance with the terms and conditions of your probation.


Unsupervised Probation means you have agreed to certain terms and conditions and must comply with those conditions, but you will not have a probation officer checking in on you. You also agree not to get in any more trouble during the probationary period.


Your risk of jail or prison time does not end until thirty (30) days after you successfully complete your probation program.
